ProSurvey Apps Limited (registered in England and Wales with company number 17118570; registered office Unit 13 Freeland Park, Wareham Road, Lytchett Matravers, Poole, BH16 6FA; registered with the Information Commissioner's Office under reference ZC191906) ("we", "our", or "us") respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit our website or use our mobile application ("DampApp Pro") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

We are the controller of your account, subscription, website and contact information. Information about your clients and their properties that you record in surveys is different: you control it, and we process it on your behalf (see section 3).

1. Information We Collect

We collect several types of information from and about users of our App, including:

  • Personal Information: Name, email address, phone number, company details, and other contact information you provide when you register for an account, generate reports, or contact us.
  • Subscription and Account Status: App-user and customer identifiers, app/platform details, subscription or trial status, entitlements, and purchase, renewal, cancellation, or expiry history, together with associated contact details. We may receive this information from RevenueCat, which manages subscription information for us, and combine it with information held in our own systems.
  • Survey Data: Information, photos, and notes you input into the App while conducting surveys. This data is stored locally on your device. If you subscribe to Pro and sign in, it is also synchronized to our cloud servers.
  • Usage Details: When you access and use the App, we may automatically collect certain details of your access to and use of the App, including app and device details, approximate location derived from your network address, logs, and the features you use. The App uses Firebase Analytics to record which features are used (not the content of your surveys) and Firebase Crashlytics to send crash reports. Both are part of how we run the App and cannot be turned off inside it; our Terms of Service make them a condition of using the App. If you allow notifications, we store a device token so that we can send them.
  • AI and Email Settings: If you add your own Google Gemini or OpenAI API key, or your own SMTP email server details, they are saved with your profile, which is synchronized to our cloud database when you are signed in.

Private B2B Edition Licensing

Private B2B editions send the organisation identifier, a generated installation identifier, app/platform label and activation or renewal credentials to our licensing service. We store licence status, device allocations, activation-code usage and check times to administer business access. Survey records and photographs are not sent as part of licence verification, and surveyors do not need to sign in for licensing. B2B portal administrators provide a verified email address; we retain their licence requests and an audit of administrative changes. Hashed network addresses help limit abusive requests. This licensing mechanism does not apply to the public consumer editions.

Microphone & Voice Dictation

DampApp Pro includes an optional voice dictation feature so you can speak survey observations instead of typing them. If you choose to use it, the App requests access to your device's microphone. Your speech is converted to text by your device's built-in speech recognition service (provided by Apple on iOS and Google on Android); to perform this conversion, your operating system may transmit the audio to Apple or Google for processing, subject to their respective privacy policies. We do not record, store, listen to, or transmit your audio to our own servers — only the resulting transcribed text is saved, as part of the survey content that you control. The feature is entirely optional: if you do not grant microphone permission, or simply do not use dictation, no audio is captured or processed.

AI Features

AI Polish, Smart Build, photo analysis and AI report summaries are optional and run only when you use them. When you do, the text, photos and survey details needed for that request (for example the notes you are polishing, or the photos you choose to analyse) are sent to an AI provider and the result is returned to the App:

  • Free AI allowance: the request passes through our cloud functions to Google Gemini under our account. We use Gemini's paid service, under which Google does not use the request or its answer to improve its products and keeps them only for a limited time to detect misuse. We keep a count of AI requests per account to apply usage limits; we do not keep the content of the request.
  • Your own API key (Pro): the request goes directly from your device to Google Gemini or OpenAI under your own account with that provider, and that provider's terms and privacy policy apply.

Photos are sent as they are, so avoid analysing photos that show people or documents you do not need in the report. AI output can be wrong and must be checked before you use it (see our Terms of Service).

Subscriptions & Install Source

To manage subscriptions and offers, the App shares with RevenueCat your app-user identifier, name, email address, phone number, company name, region, Pro status, app version and simple usage counts (such as surveys stored, reports exported, AI use, the date you first used the App, and any reason you give us for not upgrading). On Android, the App also reads the Google Play install referrer, which says whether the App was found by a store search or through one of our web pages and which one. It contains no personal details, and it is recorded in RevenueCat and Firebase Analytics so that we can tell which of our pages lead to installs.

We may also use RevenueCat's advertising integrations to tell Meta when a trial or subscription starts, renews or ends, so that we can measure our adverts. These events carry the product, price and device or advertising identifiers, never your survey content. On iPhone and iPad, the advertising identifier is shared only if you allow the App to track you when asked.

Anonymised Benchmarks (Optional)

If you turn on anonymised data sharing in the App, each damp finding you analyse sends its damp type, severity, defect tags, country or market, and whether a meter reading was taken to our benchmarking service. It does not include names, addresses, photos or notes. We publish only aggregated figures, and we delete the underlying records after 90 days. You can turn sharing off at any time in the App.

2. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide you with the App and its contents, and any other information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it (e.g., generating survey reports).
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our App or any products or services we offer or provide though it.
  • To provide onboarding or subscription help, ask for feedback, and, where the law permits, tell you about subscriptions and similar ProSurvey products or services that may be relevant to you.
  • To maintain a suppression record so that we continue to respect marketing opt-outs.

Our Lawful Bases

  • Contract: providing the App, your account, cloud sync, reports, AI features, subscriptions and support.
  • Legitimate interests: keeping the service secure and preventing abuse, app analytics and crash reports that help us fix and improve the App, learning which of our pages lead to installs, measuring our advertising, and the product follow-up described below. You can object to any of these by contacting us. App analytics and crash reports cannot be turned off inside the App, so if you object to them we may only be able to respect that by closing your account.
  • Consent: website analytics and advertising cookies, optional benchmark sharing, microphone access, and electronic marketing where the law requires consent. You can withdraw consent at any time.
  • Legal obligation: keeping billing, tax and accounting records.

Product Follow-up & Direct Marketing

We may use limited account, contact, app-usage, and subscription-status information — including information received through RevenueCat — to identify people who have installed or used DampApp Pro but have not started a paid subscription, or whose trial or subscription has ended. We may contact them to offer help, ask for feedback, or explain our own similar products and subscription options. We rely on our legitimate interests in supporting users and developing and promoting our services only where a balancing assessment shows that those interests are not overridden by the individual's rights. Where consent is legally required, we rely on consent instead.

Simply installing the App or creating an account does not by itself amount to consent to electronic marketing. We send email, text, telephone, or similar direct marketing only where permitted by applicable law — for example, with consent, under the limited PECR "soft opt-in" where every requirement is met, or under the rules applicable to corporate subscribers and business contacts. Every marketing communication will identify us and provide a simple way to opt out. You may object to direct marketing at any time; we will stop using your information for that purpose and retain only the minimum suppression information needed to respect your choice.

3. Surveyor Responsibilities as Data Controller

When using DampApp Pro to collect and process data relating to your clients, you act as the Data Controller under the General Data Protection Regulation (GDPR) and equivalent frameworks. You are solely responsible for ensuring you have the legal right and necessary permissions to collect, store, and process your clients' personal information through our App.

It is entirely your responsibility to manage data subject requests (such as requests for deletion, access, or export of client data) and to verify the accuracy of all data inputted into or generated by the application. For this information we act as your data processor, under the data processing terms in section 6 of our Terms of Service, and we accept no liability for regulatory data breaches originating from your use of the App.

If you are a surveyor's client and want to use your data protection rights, please contact your surveyor first, as they control your information.

4. Data Retention & Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Information you synchronize is stored with Google Firebase, encrypted in transit and at rest, and access is restricted to your account.

While we strive to protect your data, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security and accept no liability for accidental data loss arising from server outages, device failure, or internet disruptions. Users are responsible for regularly exporting and securing their own client data.

Cloud Data Retention Policy

To maintain server performance and minimize privacy risks, we automatically purge stale data from our cloud databases. By using DampApp Pro, you acknowledge and agree to the following automated deletion schedules:

  • Expired PRO Subscriptions: If your PRO subscription expires or is cancelled, you have a 30-day grace period to export your data or renew. After 30 days, all your cloud-synced surveys, images, and profile data will be permanently deleted.
  • Inactive Accounts: Any PRO account that has not been logged into or actively opened for 365 consecutive days will be permanently deleted, including all associated cloud storage, even if the subscription is still active. Free accounts keep their surveys on the device only, so we hold no cloud data for them to delete.
  • Storage Caps: To maintain system performance, Free accounts are strictly limited to retaining 25 surveys on the device at any time (Free surveys are not synchronized to the cloud). Active PRO accounts are permitted to store up to 5,000 cloud-synced surveys. Users nearing these limits must manually permanently delete or externally export obsolete surveys (e.g., via PDF or JSON) to free up storage space.
  • Data Portability & Export Modalities: To assist you with your GDPR obligations, DampApp Pro provides several data export options:
    • Individual Survey Exports: Exporting a single survey (e.g., to PDF) will include all associated media and images.
    • PRO Web Dashboard Exports: Exporting through the dedicated DampApp PRO web dashboard includes all high-resolution images and media attached to the surveys.
    • JSON Mass Import/Export: The in-app facility for mass exporting or importing raw .json database records strictly excludes all local images and media. This is designed to minimize unencrypted data payloads and protect client privacy during device transfers. However, if you are an active PRO subscriber utilizing our Cloud Sync feature, the exported JSON file will contain secure database links to your media already stored in our cloud infrastructure, allowing those images to be restored upon import. We accept no liability for data loss or mismanagement of files exported to external, unmanaged environments.

You can delete your account and cloud data at any time from the App or at dampapp.pro/delete. Export anything you need first, in the App or at dampapp.pro/export. We keep billing and tax records for as long as the law requires.

Marketing Records

A contractor's working copy of a contact list is limited to the relevant campaign or contract and must be securely deleted or returned when no longer required. We periodically review our own follow-up records and keep them only while they remain relevant and lawful. If you opt out or object, we may retain a minimal suppression record for as long as needed to ensure that we do not contact you again for direct marketing.

5. Third-Party Services

We use these service providers to run DampApp Pro:

  • Google: Firebase (sign-in, cloud database and file storage, cloud functions, App Check, Analytics, Crashlytics and notifications), Gemini for the free AI allowance, Places for address search, and Gmail for reports and support emails sent through our servers.
  • RevenueCat: subscription and identity management, as described in section 1.
  • Meta: subscription events for advertising measurement, if we turn that on (see section 1), and the Meta Pixel on our website with your consent.
  • Apple and Google: the app stores, in-app payments, Sign in with Apple and Google, and on-device speech recognition.
  • Google or OpenAI under your own account: only if you add your own AI key.
  • Property, weather and map lookups: OpenStreetMap (address search and map tiles), Open-Meteo and OpenWeatherMap (weather), RainViewer (rain radar), ISRIC SoilGrids (soil data), the GOV.UK Energy Performance of Buildings Data Registry, and public planning, heritage and flood datasets (including planning.data.gov.uk, Historic England, Cadw, SEPA, the Environment Agency and Northern Ireland government services). These receive the address, postcode or map position being looked up and your device's network address, not your account details or survey notes.
  • Your own email server: if you configure custom SMTP, reports you email are sent through it.

Where a provider acts as our processor, we require appropriate contractual and security safeguards; a service that you independently choose or configure may process information under its own terms and privacy policy.

We may give a contracted marketing, communications, or user-support specialist limited access to a contact list so that they can carry out the follow-up described in section 2 only on our behalf and documented instructions. The limited fields may include name, business or personal contact details, app/account identifiers, app used, and subscription or trial status and dates. We do not give them survey content, property information, photographs, notes, or your clients' data for this purpose. They must keep the information confidential and secure, may not sell it or use it for their own purposes, and must delete or return it at the end of the work. We remain responsible for this processing. We do not sell your personal data.

6. International Transfers

Some of our providers, including Google, RevenueCat, OpenAI, Meta and LinkedIn, process data in the United States or elsewhere outside the UK, and our cloud functions run in the United States. Where personal data leaves the UK, we rely on UK adequacy regulations (including the UK Extension to the EU-US Data Privacy Framework for certified recipients) or on the UK International Data Transfer Addendum to the EU standard contractual clauses in the provider's data processing terms.

7. Cookies, Analytics & Advertising

Our website uses strictly necessary cookies to function. With your consent, we also load marketing and analytics cookies from third-party advertising and analytics partners — currently Firebase Analytics (Google LLC), the Meta Pixel (Meta Platforms, Inc.) and the LinkedIn Insight Tag (LinkedIn Corporation), and we may add or change comparable partners in future. These help us understand how visitors find DampApp Pro and measure the performance of our advertising. No marketing or analytics cookies are set until you accept them via our cookie banner. You can change your choice at any time with the Cookie settings link at the foot of every page; your choice is saved in your browser's local storage. We use this data for our own analytics and advertising measurement only — we never sell your personal data. These partners process data in accordance with their own privacy policies, and where required we rely on privacy-preserving and consent-based mechanisms rather than cross-app device tracking.

8. Your Rights & Marketing Choices

Under UK data protection law, you may have rights to request access, rectification, erasure, restriction, or portability of your personal data, and to object to certain processing. You may also withdraw consent at any time where we rely on consent. These rights may be subject to legal limits.

Your right to object to the use of your personal data for direct marketing is absolute. Use the unsubscribe or opt-out method in the communication, tell the person contacting you, or use our marketing opt-out form. You can also email [email protected]. We will honour the request and place the minimum details on our suppression list. You may also complain to the UK Information Commissioner's Office.

DampApp Pro™, PropertySurvey Pro™, and ProSurvey Apps™ are trademarks of ProSurvey Apps Limited. Unauthorised use of these marks is prohibited.
